Terms & Conditions of Service

Please review these Terms carefully. By using Laxmock, you agree to these conditions and all policies referenced herein. These terms govern your access to and use of our AI-powered interview practice platform.

1. Agreement to Terms

By accessing or using Laxmock ('Service', 'Platform', 'we', 'us', 'our'), you agree to be bound by these Terms and Conditions ('Terms').

If you disagree with any part of these terms, you do not have permission to access the service.

The service provides AI-powered mock interviews, practice sessions, feedback generation, and related career preparation tools.

If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms apply to all users, including visitors, registered users, and paid subscribers.

2. User Accounts & Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use this service.

You must provide accurate, current, and complete information during registration.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must notify us immediately of any unauthorized use of your account or security breach.

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

One person or entity may not maintain more than one free account.

3. Subscription Plans & Payments

Subscriptions are billed monthly in US Dollars (USD) and processed through Dodo Payments, our secure payment processor.

Payment methods include credit/debit cards, Google Pay, Apple Pay, and other methods accepted by Dodo Payments globally.

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.

You authorize us to charge the payment method on file for recurring subscription fees.

Price changes will be communicated at least 30 days in advance and take effect on your next billing cycle.

Applicable taxes will be added to your bill based on your billing location.

You can cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

Plan changes (upgrades and downgrades) are subject to a 7-day cooldown period to prevent billing issues and ensure accurate proration.

Upgrades are applied immediately with prorated billing. Your credits are reset to the new plan's allocation.

Downgrades to paid plans are applied immediately with billing credit for unused time applied to future renewals. Your credits are capped at the new plan's limit (never increased).

Downgrades to the Free plan are scheduled to take effect at the end of your current billing period.

4. Credits System & Usage

Credits are the virtual currency used to access AI-powered features including interviews, feedback generation, and analysis.

Monthly subscription plans (Free, Starter, Pro, Premium) include a set number of credits that reset each billing cycle.

Credits reset at the start of each billing cycle. Unused credits do not roll over to the next month.

Credits are tied to your account and non-transferable.

Credits have no cash value and cannot be exchanged, refunded, or redeemed for money.

When you start an interview, a minimum of 25 credits are deducted upfront. Final credit deduction depends on actual usage.

You cannot create a new interview if you have incomplete interviews pending (scheduled or in-progress).

When upgrading your plan, your credits are reset to the new plan's monthly allocation.

When downgrading your plan, your credits are capped at the new plan's limit. You cannot gain credits by downgrading.

We reserve the right to adjust credit pricing for features to reflect changes in AI model costs, infrastructure, or service enhancements.

Abuse of the credit system (fraud, automated abuse, reselling, rapid plan switching) may result in forfeiture of credits and account termination.

5. Refund Policy

Due to the immediate delivery of digital services and AI-generated content, all sales are final and generally non-refundable.

Subscription fees are non-refundable once a billing period has started.

Credits are non-refundable once added to your account.

If you believe you were charged in error or experienced a technical issue preventing service use, contact our support team within 7 days for review.

Refunds, if approved, will be issued to the original payment method within 10-15 business days.

Partial refunds may be provided at our discretion for unused subscription periods in cases of service failure or billing errors.

6. AI-Generated Content & Limitations

Our AI systems generate interview questions, feedback, and suggestions based on machine learning models and may not always be accurate, complete, or appropriate.

AI-generated content is for practice and educational purposes only and should not be considered professional career advice or coaching.

You should verify important information and use your own judgment when acting on AI-generated suggestions.

We do not guarantee that AI responses will be error-free, unbiased, or suitable for your specific situation.

The quality of feedback depends on the quality and completeness of your responses.

We continuously improve our AI models, which may result in variations in output quality and style over time.

7. User Content & Intellectual Property

You retain ownership of all content you submit, including interview responses, answers, and any uploaded materials ('User Content').

By using the service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your User Content to provide and improve the service.

We may use anonymized and aggregated User Content to train and improve our AI models and service quality.

You represent that you have all necessary rights to the User Content you submit and that it does not violate any third-party rights.

You agree not to submit content that infringes intellectual property rights, violates privacy, or is illegal.

We own all rights to the service, including the platform, AI models, algorithms, designs, logos, and generated questions.

8. Privacy & Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

By using the service, you consent to our Privacy Policy and our data practices described therein.

We implement industry-standard security measures including encryption, access controls, and monitoring.

Interview recordings (for video interviews) are stored securely and may be processed by AI services to generate feedback.

We do not sell your personal information to third parties for marketing purposes.

You can request access to, correction of, or deletion of your personal data as described in our Privacy Policy.

Data retention periods and your rights are detailed in our Privacy Policy.

9. Acceptable Use Policy

You agree to use the service only for lawful purposes and in accordance with these Terms.

You will not use the service to generate, distribute, or promote illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory content.

You will not attempt to gain unauthorized access to any portion of the service, other users' accounts, or connected systems.

You will not use automated systems (bots, scrapers, etc.) to access the service except through our official APIs (if available).

You will not interfere with or disrupt the service or servers, or violate any requirements, procedures, or policies of connected networks.

You will not reverse engineer, decompile, or attempt to extract source code from our service.

You will not use the service to transmit viruses, malware, or any malicious code.

You will not resell, redistribute, or commercialize access to the service without our written permission.

You will not impersonate another person or entity or misrepresent your affiliation.

10. Third-Party Services

Our service integrates with third-party services including OpenAI (for AI generation), Dodo Payments (for payments), and cloud hosting providers.

Your use of third-party services through our platform is subject to their respective terms and privacy policies.

We are not responsible for the availability, content, or practices of third-party services.

We do not endorse or control third-party services and are not liable for any damage arising from their use.

Links to external websites are provided for convenience and do not constitute endorsement.

11. Service Availability & Changes

We strive to maintain high availability but do not guarantee uninterrupted or error-free service.

We may modify, suspend, or discontinue any part of the service at any time with or without notice.

Scheduled maintenance will be announced in advance when possible.

We reserve the right to impose usage limits or modify features to ensure fair use and service quality.

We may update AI models, user interface, or features to improve the service.

Significant changes affecting your use of the service will be communicated via email or in-app notification.

12. Account Termination

You may terminate your account at any time by contacting support or using account deletion features.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for other legitimate reasons.

Upon termination: (a) your right to use the service ends immediately, (b) unused credits are forfeited, (c) no refunds will be issued unless required by law.

We may retain certain data after termination as required by law or for legitimate business purposes (fraud prevention, legal compliance).

Termination does not relieve you of any obligations incurred prior to termination.

Provisions regarding intellectual property, limitations of liability, and dispute resolution survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the service will be uninterrupted, error-free, secure, or free of viruses or harmful components.

We do not warrant the accuracy, completeness, or usefulness of AI-generated content or that it will meet your specific requirements.

Any material downloaded or obtained through the service is at your own risk.

Some jurisdictions do not allow disclaimers of implied warranties; in such cases, the above disclaimers may not apply to you.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM, OR INR 1,000, WHICHEVER IS GREATER.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether we were advised of the possibility of such damages.

Some jurisdictions do not allow limitations on liability; in such cases, our liability is limited to the maximum extent permitted by law.

These limitations apply to claims arising from: (a) use or inability to use the service, (b) unauthorized access to your data, (c) third-party conduct or content, (d) AI-generated content accuracy or reliability.

15. Indemnification

You agree to indemnify, defend, and hold harmless Laxmock, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

(a) Your violation of these Terms or applicable laws

(b) Your User Content or any content you submit

(d) Your breach of any representation or warranty made herein

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.

16. Dispute Resolution & Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

Any dispute arising from these Terms or the service shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.

Arbitration shall be conducted in English and seated in [Your City], India, by a single arbitrator appointed mutually.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding arbitration, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time to reflect changes in our service, legal requirements, or business practices.

Material changes will be notified via email or prominent notice on the platform at least 15 days before taking effect.

The 'Last Updated' date at the top indicates when terms were last modified.

Continued use of the service after changes take effect constitutes acceptance of the modified Terms.

If you do not agree to modified Terms, you must stop using the service and may cancel your subscription for a pro-rated refund if changes materially reduce your rights.

18. General Provisions

These Terms constitute the entire agreement between you and Laxmock regarding the service.

Our failure to enforce any right or provision does not constitute a waiver of that right.

If any provision is held invalid, the remaining provisions remain enforceable.

You may not assign or transfer these Terms without our written consent; we may assign our rights without restriction.

Section headings are for convenience only and do not affect interpretation.

No agency, partnership, or employment relationship is created by these Terms.
